Al Haverkamp acts as outside general counsel for a number of developers, general contractors, and subcontractors, overseeing their litigation matters, advising them on insurance coverage and risk management, and assisting them with construction contract drafting. Al has over 30 years of experience representing commercial and residential developers, general contractors, and subcontractors in construction disputes involving breach of contract, change orders, indemnity, delay and disruption, and insurance coverage (OCIPs, CCIPs, CGL, and Builder’s Risk policies). Al helps his construction clients successfully navigate the high-risk, high-exposure, and complex arena of California construction law.
Significant Litigation Results and Engagements:• $3.5 million recovery for Aviara Four Seasons Resort in construction dispute involving collapsing pedestrian bridges and damaged exterior walkways.• Recovered $400,000 for a general contractor in a construction payment dispute with the owner concerning the construction of a large computer chip manufacturing plant.• Successfully resolved multiple lawsuits as counsel for a mechanical contractor relating to a natural gas explosion at high rise hotel which injured 19 workers and caused $17 million in property damage.• Jury verdict and recovery of all attorney fees for the general contractor against subcontractors involving the collapse of a roadway entrance to shopping mall. Recovery included the cost of all emergency repairs required in order to meet the supermarket’s grand opening and avoid liquidated damages.• Defeated claims against developer in a class action for unfair business practices and fraud involving 110 luxury homes in the Del Mar area.• Successfully defended national land developer in soil subsidence case at 100 plus home development in La Jolla.• $325,000 construction delay recovery for the general contractor against architect and engineer.• Represented general contractor in a multi-million-dollar construction defect claim involving a famed oceanfront high rise in Santa Monica.• Successfully defended developer and general contractor in an expansive soils case at a 400-home project in Orange County.• Defense verdict for concrete subcontractor sued by building owner for alleged improper concrete pour.• Successfully defended the master developer of a 2,000-home project against claims involving multiple detention basins constructed in the community.• Arbitration award in favor of homebuilder who was sued for disgorgement of $1.5 million purchase price by the homeowner on basis that the homebuilder did not have a contractor’s license.
